STANDARD
TERMS AND CONDITIONS OF BUSINESS
The
following terms and conditions define the understanding between The Recruitment
Academy and the Client when undertaking In-House Training, Consultancy and
Seminars.
1.
Exclusivity of Training Material
1.1
The
Recruitment
Academy
undertakes Training on an exclusive basis only.
All Training Material has been copyrighted, therefore will not be able to be
represented,
copied
or duplicated in any way for further use other than by The Recruitment Academy.
2.
Confidentiality
2.1
During the Training
process, all information concerning the Training including the Client
Company’s business and executives, as well as all delegate details will be
treated with strict confidentiality by both The Recruitment Academy and the
Client.
3. Off-Limits
3.1
The
Recruitment
Academy
will never approach or recruit a person whom we have trained for a Client
company while the delegate remains in that Client's employ.
3.2
The Client will not
approach, solicit or recruit any Associate or employee of The Recruitment
Academy or introduce to any third party. If this were to happen a fee of 30% of
annual remuneration package or £15000 (whichever is the greater) would be
payable immediately to The Recruitment Academy.
4.
Presentation of Training
4.1
The
Recruitment
Academy
will organise all In-House and Seminar Training Sessions between the Client and
selected delegates.
5.
Fees and Expenses
The
Recruitment
Academy
’s fees are;
5.1
£299 + vat for each
Seminar Training Session (1 day)
5.2
£1995 +
vat (per day) for In-House Training, Consultancy, Coaching and Mentoring
Sessions
5.3
Expenses related to Trainer
travel ( for in-house training only ), lodging and additional material costs are
reimbursed by the Client to The Recruitment Academy as incurred.
6.
Terms of Payment
6.1
The Client will be invoiced
on booking a Training Session/Seminar
6.2
All invoices must be paid immediately
and the payment must be received before the training commences.
6.3
All
invoices are subject to Value Added Tax
(Changes
to the above terms of payment will only be made with prior agreement between the
Client and The Recruitment Academy.)
7. Client
Satisfaction
7.1 The
Recruitment Academy seeks Client feedback on the quality of our performance
after every Training Session delivered. At
the conclusion of any Training, the Client will be contacted by an Account
Manager requesting that the Client take part in a confidential Client
Satisfaction Survey.
8.
Cancellation or Changes to the Training Dates
8.1
Cancellation to bookings must be made 15 working days prior to the course
date.
8.2
Cancellation within 15 days prior to the course date will incur full
payment of fees
8.3 In
the case of a cancellation, only fees and expenses representing work which has
been effectively carried out up to the date of receipt of the cancellation
letter are due.
8.4
Substitutions for seminar delegates can be made at any time.
Please inform us of any changes made
8.5
Seminar delegates that transfer to alternate courses within 15 working
days of the course date will
incur a 25% administration charge. If
the transfer is cancelled full fees are applicable
9.
Non-Payment of Fees and Expenses
9.1
Failure to pay an invoice
for fees and/or expenses related to an engagement (see above Terms of Payment)
may lead to the suspension of The Recruitment Academy activities.
The engagement will be resumed upon receipt of payment of the invoice.
9.2
The
Recruitment
Academy
reserves the right to charge interest on invoiced amounts unpaid for more than
14 days from the due date until the date of payment. Interest will be charged at
the current Barclays Bank base rate +5%.
10.
Liability
10.1
The Recruitment Academy
shall not be liable under any circumstances for any loss, expense, damage,
delay, costs or compensation (whether direct, indirect or consequential) which
may be suffered or incurred by the client arising from or in any way connected
with The Recruitment Academy delivering training to the client.
11.
Law
11.1
These terms are governed by
the law of
England
and
Wales
and are subject to the exclusive jurisdiction of the courts of
England
and
Wales
.
